Under the Family Code, property acquired during marriage is divided equally. Pre-marital property and property acquired by inheritance or as a gift are considered personal property. In disputed cases, the court makes a decision taking the specific circumstances into account.
The court takes the child's interests as the primary consideration: age, health, relationship with parents, and material provision are assessed. When parents cannot agree, the court determines the child's place of residence.
Alimony is determined as a percentage of the parent's income: one-quarter (25%) for one child, one-third (33%) for two children, one-half (50%) for three or more. Alimony can also be set as a fixed monetary amount.
Family mediation is the process of parties reaching an agreement through out-of-court discussion. In Azerbaijan, participation in a mediation session before going to court is mandatory.
